Highlights of the Memorandum of Settlement November 11, 2009

(this is a summary of the highlights, not the actual language - this will be available soon). 

Term & Wage Increase – Article 38

3 Year Term Jan. 1, 2009 1.75%

New wage rate for the After Hours Attendants of $18.05/hour plus lump sum payments based on total hours worked in the period Jan.1, 2005 through to Dec. 31, 2008:
1 to 500 hours worked: $250.00
501 to 1000 hours worked: $500.00
Over 1000 hours worked: $750.00

NEW Letter of Understanding re: Full-time Jobs

- The parties agree to six (6) ways in which full-time job opportunities may become available and are retained.
- The Board agrees to create 32 new full-time jobs through the implementation of the Permanent Employees Without Permanent Positions (PEWPP), capital projects and a full-time job review, including five (5) new full-time jobs created in support of modified work accommodations.
- The parties shall establish a Joint Full-Time Review Committee that will meet in May of each year to review total extra hours worked, number of part-time and full-time jobs by classification/area/region/department, etc., with a view to creating new full-time job opportunities in the bargaining unit.

NEW Letter of Understanding re: Career Paths

The Board will develop:

1) A voluntary Mentorship Program for new librarians;
2) A voluntary Library Assistant Training program for Public Service Assistants;
3) A voluntary Community/Branch/Department Head Training for interested staff.

- The Board will make best efforts to develop a workshop for Pages that provides an orientation to career options at the Toronto Public Library.
- The Board will conduct annually an information session and discussion forum for librarians about the collection development process and opportunities for involvement.
- The Board will conduct annually an information session and discussion forum for librarians about the children’s services and collection development and opportunities for involvement.
- The Board will meet with the Union to discuss potential ways to strengthen Children’s Services at the TPL.
- Upon completion of the Library Assistant Training Program, the Board will consider expanding the mentorship program for the Library Assistants.
- The Board agrees to increase the budget for Tuition Reimbursement by $500 in each year of the agreement.

Leave of Absence for Education Leave – Article 25.01 (c)

- The Board shall grant an unpaid LOA for a period of up to 2 years to an employee who has been accepted into an accredited librarian degree (max. of 3 leaves at any one time); The Board shall consider 1 additional unpaid LOA for an employee accepted to attend another job related course of program (max. of 2 years LOA).

NEW Letter of Understanding re: Extended Open Branch Hours

Funding for late night library service hours past 8:30 p.m. will trigger:

- The creation of permanent late night positions posted in accordance with Article 16. Late night positions will be voluntary and not subject to the regular shift selection process.
- Some full-time positions will be created by combining new funding with existing part-time positions.
- Open hours shall not extend beyond 10:00 p.m. Monday to Friday and 12:00 p.m. (noon) to 5:00 p.m. on Sunday, in the District and Research & Reference libraries only.
- Suitable measures, including security guards, will be put in place to ensure the safety of all employees.
- Staffing to provide reference and circulation services for all late night locations.

Health & Safety – Article 30

- NEW: The parties negotiated a Workplace Violence policy to be incorporated in the Collective Agreement. The policy outlines the role of the Central and Regional Joint Health and Safety Committees.
- The parties agree to develop a week long annual public education campaign around the National Day of Mourning to increase awareness about violence in the workplace.

Extended Health/Dental/Group Life and LTD Benefits – Article 28

- Permanent part-time employees: the Board pays 60% cost of premiums, increased from 50%.
- List of paramedical benefits now includes psychotherapist & naturopath; no increase to overall maximum of $2400.
- Employees can combine 2 year’s worth of vision coverage to a maximum of $900 for laser eye surgery.
- Dental Procedures Frequency Limits moved from every 6 months to every 9 months. Eligible dependents under the age of 18 remain at every 6 months.
- Post-65 benefits negotiated as a result of the end of mandatory retirement: all active employees shall receive extended health & dental coverage same as all employees; Group Life & Accidental Death Dismemberment coverage changes to $20,000 effective the 1st of the month following an employee’s 70th birthday; new Long Term Disability provision for employees over age of 65.

Supplemental Employment Benefits – Pregnancy & Parental Leave – Article 25.10

- Employment Insurance top-up increased from 75% to 80%.

Temporary employees – Article 7.04

- The start date of the temporary position will be the effective start date for the purpose of granting vacation entitlement and wage increments.

Promotions, Vacancies & New Positions – Article 16

- After Hours Attendants, Web Librarian and Web Technician positions to be filled on the basis of senior qualified.
- Where a vacancy occurs within 30 days of the initial appointment, the vacated position will be offered to the next eligible candidate.
- Employees will be offered alternate employment in order of seniority in the event of an extended branch closure due to renovations requiring the temporary transfer of employees.
- Voluntary location exchanges will be posted on the staff intranet for a minimum of 2 weeks and if there is a match, the voluntary location exchange may take place.

Posting of seniority lists – Article 17.03

- Integrated seniority lists shall be posted on the intranet monthly.

Hours of Work – Article 19

- Web services bands extended: Monday to Friday 8:00 a.m. to 8:30 p.m.; Saturday 8:00 a.m. to 5:00 p.m.
- Marketing & Communications bands extended: Monday to Friday 8:00 a.m. to 8:30 p.m.
- The parties will meet to discuss the implementation of the bands for Web Services and Marketing and Communications with a view to minimizing the impact on individuals within the departments.

Call – no return to work – New Article 20.07 (c)

- Employees in the IT department and Theatre Liaison Officers contacted outside work hours for unscheduled special circumstances and who agree to perform work from home shall receive time and one-half (1 ½) regular rate for all time spent on the call for a minimum of 30 minutes.

Sunday Work – Article 20.08

- Where staff is required to fill vacancies due to withdrawals by employees after the commencement of the Sunday session, such staff will be appointed in order of seniority from the group of applicants who have not received a Sunday appointment.

Standby – Article 20.09

- The respective location, district and area/region will establish biannual lists of employees interested in working on standby. Employees shall be offered standby in order of seniority on a rotating basis.

Evening & Saturday Shift Premiums – Article 21
- Evening: $1.00 effective Jan.1, 2009; $1.02 effective Jan.1, 2010; $1.04 effective Jan. 1, 2011
- Saturday: $1.22 effective Jan. 1, 2009; $1.25 effective Jan. 1, 2010; $1.27 effective Jan. 1, 2011.

Paid holidays – Full-time Employees – Article 22

- Family Day added to the list of paid holidays (bringing total to 11 paid holidays).

Language Bonus – Article 26.06

- Cataloguers and SLA’s performing cataloguing in any language other than English will be paid an honorarium of $250 for up to 50 hours and $500 for over 50 hours.
- Any employee performing programming in any language other than English will be paid an honorarium of $250 for up to 50 hours and $500 for over 50 hours.

Clothing Allowance – Article 33.01

- Board agrees to provide 1 winter toque; 5 pairs of trousers OR shorts for truck drivers; rubber boots in vehicles and branches/departments, as required & UV sunscreen to employees required to work outdoors.

In-charge Duties – Letter of Understanding 20

- Increase from $1000.00 to $1,200.00 for Senior Library Assistants.

NEW Letter of Agreement re: In-sourcing of custodial work

- The parties agree that funding received for the in-sourcing of custodial work will result in establishing a custodian position in the bargaining unit at the rate of $20.35. Parties agree on the job description for the custodian position.

Pages

- Page appointed to a temp full-time position for a period in excess of 3 months shall have the option of receiving 1 ½ cumulative sick days – Article 24.07
- NEW LOU re: Electronic Communication - All permanent employees, including pages, who have completed their probationary period will be provided with email accounts.
- Pages will receive a lump sum payment prorated to a maximum of $700.

Grievances

- The parties agree to an expedited arbitration process to resolve outstanding Article 16 job posting and reclassification grievances and agree to timelines around the process.

Joint Committees

- Parties agree to meet as the Joint Modified Work Committee at least 4 times/year (Article 35.02)
- Parties agree the Redeployment Committee will meet twice/year (Article 18.02 c)

Workshops

- New LOU: The Board and the Union shall meet to implement educational workshops for all staff about mental health issues in the workplace.
- An annual Human Rights workshop.
